Sococo, Inc. is committed to protecting your privacy. This privacy policy (“Privacy Policy”) describes how both Sococo, Inc. and its affiliate, Postwire, maintain, use and share information that they may collect when you use the Sococo, Inc. and Postwire websites (the “Sites”) and services. If you are employed by Sococo, Inc. or one of its affiliates, please see the last section of this Privacy Policy which addresses how we use your personal information related to your employment. This Privacy Policy also applies to Sococo’s affiliated company, VisibleGains, Inc. (“VisibleGains”). For convenience, Sococo, Inc., Postwire and VisibleGains are collectively referred to as “Sococo,” “We,” or “Us” in this Privacy Policy.

We do not collect, use, or disclose any information about users of our Sites and services except as described in this Privacy Policy. This Privacy Policy seeks to comply with all applicable data security and privacy laws, including, but not limited to, the new European Union General Data Protection Regulations (“GDPR”).

What information do we collect?
We collect information from you when you register a new account on our Sites, subscribe to our newsletter or fill out a form.

When ordering or registering on our Sites, as appropriate, you may be asked to enter information such as: name, e-mail address, phone number, job title, or company name. You may, however, visit our Sites anonymously.

In the event that you contact us for customer support through our products and services or Sites, we may also request that you provide additional user information relevant to the support requested by you. Users are under no obligation to provide such information (hereinafter referred to as “personal information” and, with respect to the subset of information by which a user may be identified, “personal data”). However, we cannot guarantee that we can provide customer support in the event that relevant information related to the use of our products or services is withheld. We may retain communications relating to customer support, and/or information drawn from such communications, for statistical and/or reference purposes, but will not publicly release such information except in anonymized form unless required by applicable laws.

What do we use your information for?
Any of the personal information we collect from you may be used in one of the following ways:

  • To personalize your experience. Your personal information helps us to better respond to your individual needs.
  • To improve our Sites and product and service offerings. We continually strive to improve our offerings based on the information and feedback we receive from you.
  • To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs.
  • To process transactions. Your personal information and personal data, whether public or private, will not be sold, rented, or leased to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.
  • To send periodic emails such as product updates, newsletters, and other company communications.

How do we protect your information?
We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private purchase-related information (credit/debit card numbers, billing information, etc.) will not be retained or stored on our servers.

Choice – Right of Access, Correct, Update and Delete Personal Information
You have the right to access your personal information and your personal data, and the right to correct, update, or have your personal information removed from our records and systems. You also have the right to obtain a copy of your personal information held by Sococo. Any such inquiries or requests can be made using the contact information provided in this Privacy Policy.

Our Services

Sococo Service in General
Because Sococo (including affiliates) strives to enable communications among people, depending on your settings, certain information you provide may be available to other users.

We may collect various types of information from your use of Sococo. For example, we may collect information about user traffic and usage patterns throughout our Sites, and similar information regarding the use of our software and other aspects of Sococo. For example, when you log in to Sococo, or when you use Sococo to communicate with other Sococo users to share other types of user content with them (e.g., through screen-sharing functionality), we maintain records regarding the other users who you communicated with, the duration of your communications, and regarding the user content you shared, as well as other information regarding your use of the service (e.g., the areas of Sococo that you navigated to, and the dates and times of your activities). We also track information such as the team spaces that you are invited to and that you join and participate in.

Please note chat content and other communications and collaboration activity will not be retained, stored or saved locally or at an organizational level on Sococo’s systems. The scope of customer content retained, stored or saved is limited to user profile data (first name, last name, email address, and Room Share URLS). Sococo is not responsible for other users who participate in chat and choose to save chat content using a third party service. Additionally, please be aware that although we do not save any audio and video content on the service (collectively, “Communications Content”), we reserve the right to do so as reasonably necessary to provide the service, including but not limited to reviewing and monitoring (or permitting third parties such as law enforcement personnel to review or monitor) Communications Content and other collaboration and communications activity in the following circumstances: (a) to respond to support legal requests; (b) to detect, prevent, or otherwise address fraud, security, or technical issues; (c) as we deem necessary or advisable in good faith to conform to legal requirements or comply with legal process; or (d) to enforce our agreements with you, including our terms of service, and including investigations of potential violations thereof. As a condition of using Sococo, you agree that Sococo cannot prevent chat content storing by other users, as well as the reviewing and monitoring of Communications Content by Sococo in the limited contexts described above.

In addition to using cookies and related technologies as described above, certain portions of our Sites may also use third-party analytics providers to analyze users’ use of the Sites. These analytics providers provide us with aggregated data that we may use and disclose for various purposes. For example, we may use the information to control the number of times you have seen an ad, deliver ads tailored to your interests, and measure the effectiveness of ad campaigns.

Additionally, we may rely on or permit third-party companies to perform the functions described in the above paragraph, including, but not limited to, displaying ads tailored to your interests on third-party websites. These third-party companies may deliver ads that might also place cookies and otherwise track user behavior on the Sites and on third-party websites.

Sococo may contain links to and interoperability with third-party sites, software, and services. Any links to, or interoperability with, third-party sites, software, or services are provided for your convenience only, and we do not have control over the content or privacy and security practices and policies of such third parties. Any personal information that you provide to our data destination partners or to other third parties is subject to that third party’s privacy practices and policies, not this Privacy Policy. We encourage you to learn about their privacy and security practices and policies before providing them with personal information or personal data. 

Do we use cookies?
Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the sites or service provider’s systems to recognize your browser and capture and remember certain information.

We use cookies to understand and save your preferences for future visits and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding visitors to our Sites. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

Do we disclose any information to outside parties?
Sococo does not sell, rent or lease its customer lists to third parties. Sococo may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personal information/personal data (e-mail, name, address, telephone number) is not transferred to the third party.

Sococo may share your personal information with service provider vendors who are acting on Sococo’s behalf to operate the Sites and provide our products and services, including software service hosting facilities. Such service providers are subject to contractual obligations with respect to the use, protection and non-disclosure of your personal information. Notwithstanding such legal and contractual obligations, Sococo remains potentially liable for any misuse of your personal information by such service provider business partners.

Sococo will disclose your personal information or personal data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Sococo or the Sites; (b) protect and defend the rights or property of Sococo; and, (c) act under exigent circumstances to protect the personal safety of users of Sococo, or the public.

Third party links
Occasionally, at our discretion, we may include or offer third party products or services on our Sites. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our Sites and welcome any feedback about these third party sites.

Children’s Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). We do not collect any information from anyone under 13 years of age. Our Sites, products and services are all directed to people who are at least 13 years old.

EU-US Privacy Shield
Sococo complies with EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries. Sococo has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. If there is any conflict between the policies in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Enforcement: EU-US Privacy Shield
Sococo uses a self-assessment approach to ensure compliance with this Privacy Policy and periodically verifies that the Policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented, and accessible.

We encourage interested persons to raise concerns using the contact information provided in this Privacy Policy, and Sococo will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of your personal information.

In addition to self-assessment, as a participant in the EU-US Privacy Shield program, Sococo is subject to the investigatory and enforcement powers and authority of the U.S. Federal Trade Commission with respect to maintenance of, and adherence to, this Privacy Policy. Under certain limited and prescribed circumstances and conditions, you have the right to invoke a “last resort” binding arbitration process between you and Sococo to resolve a dispute related to Sococo’s collection, use or disclosure of your personal information.

In compliance with the EU-US Privacy Shield Principles, Sococo commits to resolve complaints about your privacy and our collection or use of your personal information. European Union individuals with inquiries or complaints regarding this Privacy Policy should first contact Sococo using the contact information provided in this Privacy Policy.

Sococo has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. Sococo commits to adhering to the requirements of the GDPR for Sococo service users resident in European Union countries who qualify as GDPR data subjects, including the right to data erasure if user consent is withdrawn, no longer needed to achieve the purpose it was collected for or unlawfully obtained. Complaints or enforcement from EU residents or EU data protection agencies (“DPAs”) may be pursued by means of the above-described EU-US Privacy Shield process.

Your Consent
By using our Sites or our products and services, you consent to the terms and conditions of this Privacy Policy including the collection and use of your personal information and personal data as specified in this Privacy Policy. You will be asked to confirm this affirmative consent in a click box before using Sococo or Postwire products or services. Your consent also grants Sococo the ability to communicate with you via email and other communication forms with respect to Sococo and Postwire, and any additional products and services owned by Sococo, Inc.

Changes to our Privacy Policy

Rights Related to Sococo’s Employees in the European Union
If you are a citizen of a member state of the European Union employed by Sococo and/or one of its affiliates and reside in the EU, your personal information and personal data is subject to the principles set forth in this Privacy Policy. In consideration of your employment, you consent to the transfer from the EU to the United States of certain of your personal information, including name, postal address, telephone number, and information related to your employment status, including personally identifiable information and/or personal data necessary to establish and maintain your employment. Your information will be used by Sococo for the limited purposes related to your employment and any transfer to third parties (e.g., payroll processing) is covered specifically by the Onward Transfer principle described in this Privacy Policy. You may access your personal information at any time for the purposes described further in this Privacy Policy and may contact Sococo using the contact information or personal data provided herein or by the Sococo EU affiliate with which you are employed.

In addition, Sococo and its affiliates in the EU commit to cooperate with the panel or panels established by the EU DPAs and comply with the advice given by such panels with regard to human resource data transferred from the European Union to the United States in the context of your employment.
